PERSONAL DATA NOTICE FOR THE USE OF THE FORM ON THE WEBSITE (art. 13 EU Regulation 2016/679)
AL.MO S.R.L., VAT number 04463780165, with registered office at Via per Curnasco 52, 24127 Bergamo (BG), as the Data Controller, provides this notice to inform users who write on the contact form on the company website www.almologistic.com about the processing of personal data.
DATA PROCESSED
The data processed through the contact form are:
- Identifying data (name, surname)
- Contact details (mobile number, email)
PURPOSES AND LEGAL BASIS
Personal data is provided for the following purposes:
- A) To respond to your request, sent via the contact form
- B) Marketing purposes
For the purpose under point A), the legal basis is your consent, pursuant to Art. 6 par. 1 lett. a of EU Regulation 2016/679, which can be expressed by ticking a box under the contact form. Without your consent, the requested service cannot be provided.
The legal basis for the purpose under point B) is your consent, which in this case is optional and does not affect the provision of the requested service.
PROCESSING METHODS
The processing of personal data takes place, under the authority of the Data Controller, by specifically authorized and instructed subjects for processing in accordance with Art. 30 of the Privacy Code, using computer or telematic tools, strictly related to the purposes and ensuring the confidentiality and security of personal data in accordance with Art. 32 GDPR (e.g., antivirus, cybersecurity policy, etc.). The processing of personal data may also take place, on behalf of the Data Controller, by Data Processors specifically designated in accordance with Art. 28 of the Privacy Regulation. The updated list of those responsible and external subjects appointed as Data Processors is kept at the Data Controller's headquarters.
AL.MO S.R.L. uses HubSpot CRM (HubSpot, Inc.), a User database management service whose information can be found at https://legal.hubspot.com/privacy-policy.
Pursuant to Art. 5 GDPR, personal data will be:
- processed lawfully, fairly, and transparently towards the Data Subject;
- acquired and recorded for specific, explicit, and legitimate purposes, and subsequently processed in a manner compatible with those purposes;
- adequate, relevant, and limited to what is necessary in relation to the purposes for which they are processed;
- accurate and, where necessary, kept up to date;
- processed in a manner that ensures appropriate security;
- kept in a form that allows the Data Subject to be identified for a period of time not exceeding the achievement of the purposes for which they are processed.
DATA RETENTION PERIOD
The data is kept for the period necessary to fulfill the requested service, and in any case for a period not exceeding that provided for by current regulations.
USER RIGHTS
Under Articles 15 – 21 of EU Regulation 2016/679, the user who uses the website's form is granted the following rights:
- Right of access: the Data Subject has the right to obtain access to their personal data and a series of related information;
- Right to rectification: the Data Subject has the right to obtain from the Data Controller the rectification of their personal data and their modification if they are inaccurate or incomplete;
- Right to erasure (so-called "right to be forgotten"): the Data Subject has the right to obtain from the Data Controller the erasure or removal of information concerning them, where there is no valid reason (e.g., a legal obligation);
- Right to restriction: the Data Subject, under certain conditions, has the right to obtain from the Data Controller the restriction of their data, interrupting or preventing further use of the information concerning them;
- Right to data portability: the Data Subject has the right to receive their personal data provided to the Data Controller in a structured, commonly used, and machine-readable format, and has the right to transmit such data to another Data Controller without hindrance;
- Right to opposition: the Data Subject has the right to object at any time, for reasons related to their particular situation, to certain methods and types of personal data processing.
These rights can be exercised at any time by sending a communication to the email address privacy@almologistic.com. Moreover, as the Data Subject, the user has the right to lodge a complaint with the Italian Data Protecion Authority of personal data, if the conditions are met.
